Scholastic gets subpoena to identify spoiler The LA Times is reporting that the US Harry Potter publisher obtained a subpoena to learn the identity of a user who allegedly posted copies of Deathly Hallows on a California website.

Scholastic said in a court filing Monday that "materials hosted on Photobucket.com's system" contain materials that infringe copyrights owned by Scholastic and J.K. Rowling, author of the Harry Potter books. Photobucket.com, a News Corp. unit, is a website for sharing photos and videos on social networks such as MySpace.

The subpoena was sent to Gaia Interactive Inc. in San Jose seeking the identity of a user on gaiaonline.com, a social network, according to the filing in San Francisco federal court.

Gaia complied with the subpoena, removed the material and temporarily banned the user from the site, said Gaia spokesman Bill Danon.

I agree that it's disappointing that someone would go to such lengths to ruin it for everyone else. I hope that doesn't really destroy people's love for reading. As much as I am aware that knowing what happens in a 7-part novel can damage the experience, I am also aware that the majority of people who read can choose to put certain things out of their minds. If it's a video you saw, then why would you choose to continue watching it? If it's a post you saw somewhere, they why keep reading? That's my major issue here. Also, it's come to my attention that Scholastic isn't going after Gaia Interactive, but the person who posted the information therein, which is as it should be. You can't blame an entire website for the actions of one idiot. Comments such as "I hate Gaia," etc., are a bit crude, and somewhat unworthy of .. just about anyone.

Well I saw one webpage. At the top of the page it says Ron dies. At the bottom of the page it shows the book and you can read parts of it and Ron is there. I really shouldn't even be looking at it!! I am trying to control myself. But is the consensus that Ron dies or lives?

Just because scholastic got a subpoena doesnt mean that anything they posted is real. All the spoilers would have to do is post a single chapter illustration (from any book) or a single sentence without proper permission and that's enough so infringe a copyright. Heck even if the spoilers posted the book cover without permission that is copyright infringement.

Seriously, the person that leaked the book is probably the dumbest person on Earth. They aren't going to make money off of it or anything. They just leaked it, to leak it, and now they are going to suffer major consiquences, and not only that, but they are going to go down in history as one of the mosted hated people in history. Guys there are 700 something pages of the book uploaded on bit torrent. If you think its all a fake and its absolutely impossible that someone got their hands on the book and took an hour to take photos of the book, then thats fine by me. It is a few days before the release, book stores would have gotten the book by now, and there is not much security in the smaller stores, simply a written agreement. We all know how much those mean.

I don't know whether the spoilers are real or not. I do know how Title 17 works, and Scholastic is taking the first steps to protect a copyright interest from infringement. Could other action be taken? Yes, after the subpoena, Scholastic’s lawyers will sift through the records (as necessary), identify a likely culprit, petition a federal court for an immediate injunction, and then file a civil complaint for infringement. They may turn the person over to a US Attorney (Federal Prosecutor) to determine whether criminal copyright infringement charges are to be brought, but the US Attorney will determine if such charges are appropriate. And, once again I don’t mean to be rude (although accidental rudeness, as we know, is all too common), but just because we don’t know what else may be going on does not mean that the images are not authentic or that nothing else is going on. I don’t know about you, but I do not work for the US Attorney’s office; however, if Scholastic wants another IP attorney, I can send them a resume ;-).

In my opinion the spoilers look real. The epilogue makes sense if you think about how JKR said she wants to write a book for younger kids- cause there are--------------spoiler alert-------------------- ------------------------- ------------------------- ---------------- YOUNG ER KIDS in the epilogue. Kinda like Hogwarts: The next generation. There are some discrepancies with the spoilers online but I think, generally speaking, the scans of the book pages are real. So far about 456 pages have been scanned. I think the whole book will be online by tonight. If you dont want to be spoiled any more than you already have then DONT GO ON THE INTERNET for the next 3 days.

These pages (I've seen 3 from this group) seem like FANFIC writing to me. The inclusion of Dean in the Dobby pages - nobody writes about Dean Thomas except FanFic writers (sorry Dean). I just think these pages are too corny to be true. And remember, JKR slipped and accidentally implied that the trio live during her Harry, Carrie and Garp interview in August. Ah, yes indeed, copying any of the artwork without permission would be an infringement, but be careful to note I have not said that the spoilers are the infringements -- the posted images are the alleged infringement. And yes, posted images of the artwork could be the impetus for the subpoena, although I would find this quite unlikely given the wide dissemination of the artwork. Indeed, given the expense of this type of legal action, I would hazard a guess that something much for serious than cover art is at issue, although I admit that is just a guess (but I do believe my guesses on this are rather “close to the mark,” if you will).

Man, I still stand. The toughest systems have their cracks. And I find that a lot easier to believe than the idea that this Joe Guy had ALL of the resources necessary to print a faux book in the exact same style, JUST TO DUPE PEOPLE. Why he'd risk it for a farce, I cannot even fathom it it's so dumb. I guess that's why I believe it's real. The spoilers have discrepancies because no one DARES read the details. X dies, but then X is alive at the epilogue. WTF mate, read the rest of the book. Either X lives or dies, or X dies and comes back to life somehow. Or X is believed dead (remember we're seeing through Harry's glasses). WHO HERE HAS READ THE DETAILS ANYWAY? All we know is X dies, Y dies, A is actually B, Z is (fill in the blank). SIMPLE STATEMENTS. Who here knows the details? NO ONE. And no one DARES find out the details. That's why this is all so confusing for some people who don't know what to believe.

I disagree with u Trunks2598. I mean U.S. bookstores don't get the book until a day before the release. Plus Scholastic has payed like a billion dollars to keep the book safe. The only people who had it were librarians and i doubt they would ruin the pleasures of reading for children. I am sure that this is definately fake!!!!!!!!!!!!!!!!!!!!! !!!!!!!!!!!!!!!!!!!!!!!!! !!!!!!!!!!!!!!!!!

Why doesn't Scholastic/Bloomsbury ask for our help? There is no group of fans in the world other than us Potter fanatics that would track down every last shadow of a leak and report it to the publishers. Yet there is no "Report Leak HERE" site. I suppose there are technical difficulties to overcome with sorting through thousands of reports, but I think the publishers are losing a HUGE opportunity here. Good luck to the subpoena-waving lawyers whose job it is to track down online felons one case number at a time.

I don´t blame Mugglenet for reporting about the article in the newspaper guardian and to reveal the first sentences of chapter one. But I have to admit that it attracted indeed a lot of spoilers on the comments. For my own pity I was to curious and therefore I snapped some of them. Luckily I only read the name of the chapters and the first page of the first chapter. For me the main point is that I didn´t read the epilogue, so I still don´t know how it will end. But I read some of the comments, too. Some say that R... will die trough B... . But they also say in the epilogue that R... will marry ...(no hint here who). When I first relised the spoiler-pictures of the book in the web I was imidiatly aware that they were not fake. It is and it was the style of JKR, as also is the ecxerpt from chapter one her style. And I like it. Therefore I have to conclude that the spoilers are true. But for example I still don´t know how R.. will manage to marry someone in the end when he is supposed to be dead. This is one of many other reasons why I still looking forward to the book. And because of I already have read enough spoilers I say now good by Mugglenet until the release of the final Potter-book.

It seemed very genuine, yet why hasn't ANYBODY mentioned it yet??! I hope that they catch the b*stard. It's horrible with all the people trying to spoil DH. I saw some of the table of contents, and they looked realistic....however, I saw two completely different versions. I refuse to look any further into the matter. Jo didn't want any of the hard core readers and fans in general to be spoiled, and I refuse to be spoiled. We've got three more days, and we'll make it. Happy Horcrux hunting and happy reading! :P

I had a feeling of the spoilers i read were real!....Oh well, atleast i haven't seen the MAJOR spoilers like some people had seen... like the deaths..etc!!...I guess i will try and forget them!...dayz like this i wish i had a time-turner to fast forward to midnight friday!...And the people who thought it would be really cool to leak book 7....it ain't!!...its a really stupid idea so STOP!!!!....alot of people including myself have waited since we were little kidz to read the last book soo don't spoil it!!!!!!!!!

So these are genuine spoilers then? How the heck did people get their hangs on them? I never bothered reading them, but I've heard a lot of opinions. Some people believe that they seem legit, while others believe that none of the spoilers match JKR's writing style. I don't know, but I'm staying away from any spoiler someone might post.. fake or not.
