That might have given you some clues that you should not read any comments on this site. You can think it is wrong it post spoilers, but don’t whine like a little child when you see spoilers on this site and than act all outraged about it. LONG POST, BUT NOT SPOILERS :) On Monday I read that the book was on internet. I was sceptical, because it’s always the same: lots of spoilers, fanfiction… I downloaded it out of curiosity and thought: “hey, it looks like the real book!� The jacket, the copyright page, the dedicatory, the chapter index and the rest of the book. I started reading and finished it six hours ago. I think it’s the real book, and I hope it is, because, although I not approve of people scanning it before the release (I hate it), I really loved the supposed book. Take a book isn’t difficult. They are in bookstores since Saturday (or so), and we’ve seen pictures of open boxes. It won’t be difficult to take home a book, take photos of all the pages and upload them in internet. And also there’s the Scholastic petition for a subpoena, which is very significant. And many pages in other countries who where beginning to translate the book where closed this afternoon. Finally, I wanted to say, based of what I read (which may or not be true, but now I use it as a source of information) that many of the spoilers are wrong. It’s easy to read the book (or not) and write false spoilers, just to annoy people. I’m only going to say that some of them are real, but not all, and many who were posted here are rubbish. I hope what I read was the real thing, because I loved it. If it’s not, I’m sure J.K. Rowling wrote a wonderful book I’m going to love. On Saturday we’ll know the truth. ^__^

It is unlawful to make an unauthorized copy of a protected work, so the person who took the pictures was the first infringer (if they are authentic). It is also unlawful to make a copy of the unauthorized copy, and according to the Napster case and its progeny (the series of cases that followed), the mere act of downloading an electronic file that contains infringing material is itself an act of copying. Therefore, in theory, anyone who downloads the file is infringing and may be liable for statutory damages under Title 17 in the USA (I don’t practice in any other countries and I am not familiar with the penalties in those other systems). What is particularly onerous is that the cases imply that even the automatic action of your web browser archiving a file when you click on a link may be sufficient for infringement. The important thing to remember about copyright is that act of making a copy is the infringement regardless of whether the infringer intended to infringe, or even intended to make a copy. Will Scholastic go after people who looked at the files? Probably not, but the music file sharing cases leave the door open for them to try if they so desire.

, ive got something HUGE to tell you. Being the curious and SPY cheesecakeian i am, i went to a death aggie forum. and i read their plans for friday/saturday midnight releases. They are printing banners and flyers with the spoilers and also driving over in 4x4s with megaphones anouncing what happens in the book. also, and BEWARE OF THIS, they will be giving out booklets that on the front page will say GUIDES AND RULES FOR HARRY POTTER AND THE DEATHLY HALLOWS MIDNIGHT RELEASE. But there is no guide on the inside. inside they have the spoilers! so my advice is that if you are going to a midnight release, dont receive any booklet/flyer/etc from a stranger, and stay away from the roads because thats where theyll be with their megaphones. and also take your mp3 if you have one, and put on your headphones so you dont listen the spoilers the death aggies will be shouting out. :)

I would have to look up the Berne Convention (the international convention on copyright to which the US, the UK, and most of Europe are signatories), but US law is in compliance with the Berne Convention, and I believe that the strict liability aspects of copyright infringement apply throughout the Berne Convention countries. However, if you are in the UK, to my knowledge you do not have any cases as awful as Napster, and you do not have the draconian Digital Millennium Copyright Act (although I believe the UK does have a digital copyright act of some kind). Now if you are in France, for example, heaven help you, because authors have “moral rights� and ANY copy may infringe on moral rights.
