Scholastic gets subpoena to identify spoiler The LA Times is reporting that the US Harry Potter publisher obtained a subpoena to learn the identity of a user who allegedly posted copies of Deathly Hallows on a California website.

Scholastic said in a court filing Monday that "materials hosted on Photobucket.com's system" contain materials that infringe copyrights owned by Scholastic and J.K. Rowling, author of the Harry Potter books. Photobucket.com, a News Corp. unit, is a website for sharing photos and videos on social networks such as MySpace.

The subpoena was sent to Gaia Interactive Inc. in San Jose seeking the identity of a user on gaiaonline.com, a social network, according to the filing in San Francisco federal court.

Gaia complied with the subpoena, removed the material and temporarily banned the user from the site, said Gaia spokesman Bill Danon.

Isnt it so much more fun to wait for the book the come out and not know what to expect? I mean, wheres the fun in reading the ending before the rest of the book? My friends mom didnt want her to go to those midnight release things because she thought the ending would be shouted out by someone, but I doubt it...

Because I haven't run into a single "picture" of the book yet because most boards like MN don't allow you to just post a picture, just links, which means the overwhelmingly majority of people have seen the pictures were looking for them to begin with, so the guy really didn't hurt anyone.

Just because legal action has been taken, it doesn't mean that the spoilers are REAL. it just means that the person who posted it has comitted FRAUD, just by using the copyright of Harry Potter in the first place. :)

Omg.... my friend saw one of those images. She posted it in her livejournal (link to photo on flickr) and THANK GOODNESS I didn't click it. It was real? I HATE spoilers. I usually never bothers me because I finish the new books in under 15 hours and that time is devoted to the book, but for me to be spoiled beforehand is.... GRRR! Peeps who spoil = losers!

To those complaining that the story was spoiled for them: Last I checked, 'you' had control over your pc and your mouse. If you clicked on the spoilers, you were in full control of your actions and knew what you were getting yourself into. Don't be angry that the story was then spoiled. You knew better and made your choice. For those that haven't. Don't want to read it, don't click on it. Even this message page warns that spoilers might happen. Lets all be big boys and girls and take responsiblity for ourselves. That person was wrong for posting it, but we have the power to control ourselves.

The people that complain Are usually the ones who didn't want to be spoiled and DIDN'T click on some dumbass link.

Very sorry to inform u that harry potter and the deathly hallows is now easily available on the internet. I hvnt read (neither will I!!!) it but I hv seen it, n yes there is little doubt its the real thing. so beware of the spoilers, they r likely to be true now.

I've seen the video. Honestly, what a DORK, did he think he wouldn't get caught? Warping your voice and blurring your face doesn't achieve anything when posts are trackable in so many ways! In any case, spoilers don't bother me a bit. The book itself will be enthralling enough, no matter how many details might be divulged in the next few days.

I do not think that the supposed scans of the final chapter are real because they say 553 or so as the last page....but Scholastic's page count was 784 I'm not sure which scans are real though...I only saw the one of the last chapter and one other that I was tricked into seeing

Just look it this way guys. I have read a lot of theory's and heard a few "spoilers". Out of all the theory's I have heard someone is bound to be right. But that does not mean it is a spoiler. All of a sudden someone CLAIMS they have read the book and says something everybody freaks out. It could all be a lie and that is just there theory they are trying to pass off as fact. If you are one of the unfortunate ones who saw the scans than you were probably looking for them. and even if they were just sprung on you, you didn't have to read them. And even than they may not be real. People can use photo shop real well..................... .............Where the respective marks or products or services are not identical, similarity will generally be assessed by reference to whether there is a likelihood of confusion that consumers will believe the products or services originated from the trademark owner........... So just because they are pressing charges or whatever does not make it true!!!!!!!!!!!!

The point is that, how much we try to curse the spoilermakers on here, they are working for the PUBLIC, so who wants to read the spoilers just reads it, and the others will wait till the book is out. Remember two years ago, and two years ago of that too; the same situation, and we were still howling and moaning. It's just - it's not even MuggleNet's problem: when you open a newspaper website, you may see an advertorial page showing all the spoilers about the book. How much you're on the net, that much it is possible to be spoiled about the book. Only 3 days left, so what you can do is to enter MuggleNet everyday but ONLY for the news, don't read the comments, as the stuff of MuggleNet says "Beware of spoilers!", or open the comments section, directly go down to the page, write your opinion, send and directly return to the homepage. Somebody says "Please tell me the spoilers that I have read are not true!"; I understand those people because I mistakenly found some spoilers in the comments too, but spoiler means that it can be "50%" true, unless the publisher comes and says "all the material that is spreaded on the net as spoiler are fake/true!", and they won't say that, believe me. :)

amputechture - abusive slurs and cursing will get you no where. And I'm not being stupid. Those that don't want to be spoiled are intelligent enough to know that there is a risk on looking at anything that even has the word Harry Potter wrote on it. Common sense tells you that you run a risk if you go anywhere near anything related to Harry Potter right now. I am specifically talking to those who fell to temptation and are now upset that what they viewed was real.

to eedoe 4 : not to be mean or anything but i was looking at a message board i go to often and the thread title was "One of the funniest things ever" I clicked on it and boom! there was a giant image of the book. I saw a few things but nothing that really ruined the book for me. So for some of us it's not really our fault. People just need to learn to be jerks and title their threads properly :-)

i don't think they were real......i just think it was an infringement with Gaia and they had to get the spoilers off of that website because they probably signed a deal with Bloomsbury saying that they wouldn't post spoilers but they did.........So the verdict is they weren't real and the reason they had to get rid of the spoilers is because of an infringement on a deal.

The spoilers had to be real to get a subpoena, don't you guys know anything about the law? They can't just ask for someone's personal information unless they get a court to agree, in which case they have to prove that the pictures this guy posted were actually from book 7.

dumbledork62442 they don't have to be real to get a subpoena. All that has had to happen is an infringement of rights or infringement of a recorded deal. they don't have to prove that the pictures really came from book 7, all they have to do is to prove fraud.

I read the spoilers too and of course I'm blaming myself because I could just have stayed away from the comments and so on. I'm not upset that I've read the spoilers, I just really really hope they're not true because I don't like "that" ending. Although I just read about the deaths, I didn't click on the link with the details. But anyway, I so hope it's a fake.
