JK Rowling and WB sue Indian community
JK Rowling and WB sue Indian community CBC News, based in Canada, is reporting that an Indian community is being sued over their replica of the Hogwarts castle. Made out of canvas and papier mâché, the castle was going to be used in an upcoming festival. However, a representative for the community groups claims they had no idea they needed to seek permission. From CBC:

The group had also hired artists to create a replica of the Hogwarts Express, the train that Harry Potter and his young wizard friends take to the school, as well as life-sized models of the main figures in the best-selling series of books.

The group has spent about $30,000 for its replica, called a pandal.

"It's just a theme.… We have also modelled the Titanic and no-one sued us," said another organizer, Robin Mukherjee.

A lawyer will try to fight the lawsuit on Friday. For the full story, click here.

I have lost respect for JKR. we can always try defending jkr saying I don't think Jo has a hand in this or anything. but i dont think they can sue and make public statement without her consent. And for those who feel there is more to this story let me tell you what happens. Its not at all commercial. We have a festival coming up. where on streets a idol of one of our goddesses is stood with decoration for 10 days. various themes are used to celebrate the festival usually the current fav ones. like told in the article when titanic was released they had created a replica of the ship.. People simply celebrate and enjoy. The organisers who are just people of that locality put in their money and of the area and put that up. And after 10 days the idol is left in river. They dont get any money for it. It has been happening since years and years in india for various festivals. Suing for such a thing is sooo disgusting. India has been one the huge markets for HP books and films. Indians have given their love unconditionally for these books. I was fine when she sued for the pirated books in ebay and even that ad where boy looked like HP. but this??? its just for festival.. its like if you decorate Hp themes in ur home.. I guess if she had gained millions out of it she would have gladly permitted. This just so sick.. And I think Jo is very much aware of this. BUt you know what Indians have very short memory for bad things. The very same people who put up those things will flock the theaters for HP films. I dont think Jo will say the filsm adn books should not be released in this and that place bcos she will get millions from that

When I read this article yesterday, I actually hesitated before sending it into to Mugglenet. Given the fandom's decidedly pro-Jo adulation, I wasn't sure how the article would be received. Part of me actually though Mugglenet would refuse to post it. I must say I am pleasantly surprised that so many of you were as disgusted and shocked as I was. Whether JKR approved of the lawsuit has yet to be established, but I hope she responds SOON. Many pointed out that Disney is just as rabid in protecting its copyrights. I can attest to this truth as a daycare in Nepean, Ontario was ordered to paint over images of the Seven Dwarfs or pay damages to Walt Disney Corporation a few years ago. As a performing artist, I understand copyright and have had to not only respect it, but enforce it as well. However, enforcement must match the crime. If no money changed hands, can one truly claim to have been damaged? I don't think so, but then again I don't have oodles of $$$ to throw around on frivolous lawsuits. :-)

Why does Jo sue them and not Emerson and Co.? (Not that I WANT them to be sued.) :-)

Posted by berts_is_me Oct 12th 2007

It's ludicrous, I dont agree with it. But there has to be more to it. m81, Jo's not a fat man in a bad suit smoking a cigar, who swims in a pool of money, she's not petty. I dont think, she would do it for the money. Though, I'm waiting to hear, what Jo has to say. Oh, no offence to fat men who wear bad suits and smoke cigars, while in a pool of money. XD

berts_is_me, those who want to defend Jo can go on saying there is more to this. But we in India know abt these pandals adn what happens with them bcos it been happening since years. And we knwo they are not at all commercial.

^ Oh. I just have so much trouble believing Jo would do it, I mean she's let us have fanart, websites, and fanfiction. I don't know. Its just so confuzzling. Well, I hope you have a great festival, regardless what happens. =)

"They didn't know they had to ask permission." MY ASS.

Careful when you dress up as harry potter this Halloween... you might get sued... by some very rich people

Posted by pottervolfan Oct 15th 2007

Yeah...JK...thats a little bit overboard. First criticism I've ever had of JK. People want to make a fun Potter themed festival for the kids, I see no reason to stop them. And they wern't even going to use it for profit right?

Posted by ashtasht Oct 16th 2007

I would just like to let everyone know the term is First Nations not 'Indians'. Indians are from INDIA not CANADA!!!!!!!!!!!

Posted by darkveils5 Oct 17th 2007

Okay, I really do not think that is a good reason to sue them. They made a replica out of paper mache. J.K. and the WB are being kind of petty if you ask me.

Posted by jonno2k8 Oct 17th 2007

WELL I THINK THAT IS TOTALY OUT OF ORDER YOU CAN BE SUED FOR ANYTHING NOW A DAYS ITS NOT WRITE AND THEY WAITED UNTIL AFTER IT WAS BUILD EVEN THOUGH THEY NEW ALOT OF MONEY WOULD OF WENT INTO IT AND THE PEOPLE WORKING ON HP DONT NEED ANYMORE MONEY JUST THINK ABOUT HOW MUCH THEY MAKE AND IT WAS FOR A LITTLE FESTIVAL AND I ALSO THINK THERE MAY OF BEEN ALOT OG HP FANS GOING SO I THINK ITS WRONG !

Posted by danfan_1 Oct 17th 2007

like I said, they are celebrating Navarathri and they can build whatever they want to. I am Indian, and I fully suppory them. I hope J.K had nothing to do with this or I will have lost a lot of respect for her.

Posted by Rutu Oct 18th 2007

Well, hopefully Navarathri celebrations are going on nicely.......It's Durgashtami tomorrow!!!! Anyways, if anyone from India can get any pics (I know how they don't want ppl taking pics in temples, so I'm not sure if they'll let you in the pandal), then can you please send them in? Thankies!!!
