Rowling, WB file suit over companion book
The Harry Potter author and Warner Bros. filed suit in a Manhattan Court today against Harry Potter Lexicon owner Steve Vander Ark and several defendants for publishing "an unofficial encyclopedic companion to the 'Harry Potter' series," saying it "infringes copyright and attempts to cash in on the successful brand." The Harry Potter Lexicon is slated to be released by RDR Books on November 28.
Roger Rapoport, the publisher and owner of RDR Books said the companion novel "only promotes the sale of J.K. Rowling's work and we intend to publish on schedule as planned."

LOL! @ sirius_lee. You're so silly. I agree Neptune. TerrianSedai, it's possible that Jo wants to put those things in her book. Maybe the book going to be a lot bigger than we think with the stuff included from HP Lexicon. What Steve could do (I doubt it would work) is try to contact her by giving her the manuscript and it could be a collaboration effort. Both of their names could be attached to it. But, I don't know how Scholastics or Christopher Little will feel about that. Please know that I am not one of those fans who are in constant defense of her. Sometimes I agree with the suing and sometimes I think that it's enough. But, I'm looking at this situation from an author's point of view. Every single huge fan of hers tries to learn as much as they can about her and we ALL know that we can use fan fiction or websites as long as we don't profit. Every one knows so no one should be shocked by this lawsuit.
This doesn't seem like Jo at all, but then again, she is very unpredictable. She is very sue-happy, but I'm not saying that's a bad thing, I guess she has the right to sue. Put up a fight Lexicon!!!

Right, so I didn't mean to post nothing in that last post, I accidentally clicked 'post'. *Feels slightly stupid* Anyway, what I was getting at is that those other guides are also looking to profit off of the Harry Potter name, and some of them offer very little 'theory' of their own as well. Certain unauthorized 'prediction' books, which shall go unnamed but I'm sure you can think of a few, really don't predict much. They just summarize the story and tell the reader 'think about it, *nudge, nudge; wink, wink*. Why not go after those as well? It just seems arbitrary to me to pick just this specific book, either hit all similar books or don't bother.
Lawsuits suck. I like the lexicon, she even gave them an award, says she refers to them. As if she needs money, as if she needs to protect the series! The work stands alone. It is its own entity and it will endure any of these companion books if it is quality literature.

I admit we have heard some....questionable things from Jo lately but this is just rediculous! She gave the Lexicon a fansite AWARD! And besides, all theyre doing is putting together all the info Jo ever gave us! I don't think even Jo could do that herself, because she said she went on in a few times herself when she couldn't remember certain things about previous books when she was writing. This HAS to be a rumor.

This isn't a rumor. Steve at the lexicon is now publishing a lexicon book and trying to make a profit from it without JKR's permission. It's her property and he has no write to sell it. She has no problem with the free, non profit web site, she has a problem with the book he's making money off of. She even asked him and the publisher to stop and they refused. She didn't give them permission, they didn't stop when she asked, she has every right to sue them for steeling and selling her story and material.

READ THIS--For people who profess to have read these almost-1000-page Harry Potter books, you certainly are incapable of understanding a news article. **Who is being sued?**--A guy who happened to create a website. The website has nothing to do with the lawsuit. **Why the lawsuit?** This guy is publishing a book about characters he has no rights to, and the profits from this book will go predominantly to himself or his own personal causes. **Who is getting the money from Rowling's future encyclopedia?**-- Charities. Not Rowling. Questions solved. Finito.

Neptune, you and I are so on the same wavelength here **unlike most others**. No matter how much I like Steve and the Lexicon (which is a fantastic site btw, I visit it all the time) he has no right to publish it in book form and reap the profits. All he is doing is reproducing Jo's work in a different format with no original though whatsoever. After listening to him on PotterCast, I am very disappointed in his decision to do this. On that topic, I wonder what the TLC guys will say about this on their next show, no doubt Melissa will return from her break to defend Steve with an entirely new, as yet unheard of viewpoint.

SmegHead, I too am a fan of the Lexicon and I love hearing Steve on Pottercast, but just because I like the guy, and he's a fan just like me doesn't mean I'm going to side with him, because in this case he is completely in the wrong. He should have asked permission from the start. I have no idea why he thought he could publish a book compiled of Jo's info and material, her property and try to profit from it. She has every right to protect her work, the work she has worked so hard on for years....If it wasn't for her work and story there would be no Lexicon for Steve to try to profit off of.

Okay, this has gone off topic slightly. I'm gonna go now and wait to see what happens next.
Why is she just now suing over this? Lets start with the hypocrisy... You can take a look at amazon and see a ton of companion books for sale. They've been out and in the open for *years*. Saying that they offer the authors own spin on it, thats what makes a difference, is splitting hairs. I can argue that, inherently, the HPLexicon book has to have the authors own "spin". As they said, this is about someone making money off of Harry Potter. Although thats been happening for years in front of their faces. Not only in the form of books, but in the form of ads on websites. A lot of money was made there. HP Lexicon has been a major resource center for no less than Rowling herself, and her fans, for years. They are begrudged for doing what they were already doing, but putting it in paper form? What I honest to god believe is happening, is that there is a fear of the HP Lexicon book being far superior to this much trumpeted official encylopedia. Why? Rowling has a terrible problem with continuity, not to mention that what she intends to write might be far from what the fans are expecting. Ill leave it at this.
Normally I would back Jo up, but normally she would be right. In this case I'm not so sure. I don't really know what the Lexicon's book is going to be like, but I assumed it would be about the Harry Potter trivia we all already knew. I assumed that Jo's, on the other hand would be a collection of information we didn't know. There is no way that the Lexicon's Harry Potter encyclopedia could ever compete with the one Jo will write, so charities wouldn't really be losing out. Moreover, what does this mean for the other Harry Potter companion books? Does she disapprove of the mugglenet book too? And what about the book that Melissa Anelli's writing? I am really looking forward to reading that. I think Jo really cares about her fans and this is definitely not a money thing, so I just can't understand why she would do this. I'm a bit disappointed to be honest.
I just can't believe she's sunk so low as to sue the guy who created a fan site she's called home and that she's used as a resource (Book 7). I use Lexicon all the time, and though I love the books greatly, I side with Steve. Because the type of people who will buy his book, are the type that will DEFINITELY buy Jo's no matter what. Plus, his version will just have what they have on their site but in book form; loads of encyclopedia companies have textbook versions *and* websites. I just think Jo's gone "file suit" crazy. First that Indian festival, now this? C'mon.
Einnej, I have held the opinion that she might actually be trying to tick off as many of her fans as possible, since August. And I am being serious. I don't know why, perhaps she doesn't want to be tied to the series anymore. Thats what you are just now picking up IMO. ----------- As far as the book HPLexicon is coming out with, I think the problem is that it will make her own book look like crap in comparison. She won't want that regardless of what shes doing with her fans.----------- Rowling has a big problem with continuity, and remembering what she was doing or intended for/with her characters. Not to mention I have heard a couple of things that she is going to stick in there that I am 100% positive will upset her fans, like what happened with McGonagall. Than there is just what the fans are expecting, basically a history book on the series with factoids. I bet you anything thats not what we will get.
This is ridiculous. Of course Jo has a right to sue. If you can't protect your own work then what is the point of copyrighted material? And it doesn't matter that the two books would be different - it is a matter of principle. The Lexicon guy had no right to use Jo's characters and thoughts to make mass amounts of money. There is also a huge difference between a free fan site and a book. Would it be cool if mugglenet wrote Harry Potter 8 tomorrow? Or if Jo sued would she just be being a scrooge then as well? This is the law people. The Lexicon guy knew it going in and chose to ignore it - he is in the wrong here.
Rowling is on a suing spree!!! She could have asked them not to sell the encyclopedia rather than suing them. irritating!!!
It really makes no sense to me honestly there are tons of HP companion books out there. There is one called The Unofficial Harry Potter Encyclopedia: Harry Potter A-Z. If Jo thinks that this book would take away from her Official Encyclopedia she is delusional. I’m under the impression that her Encyclopedia will contain content that we don’t know. Stuff about characters back stories, perhaps even filling in some stuff that takes places between the end of DH and the epilogue. Small things like character height, birthdates etc. If Jo was that concerned about people making a personnel income off her creation then she should sue to shut down mugglenet,Lexicon etc (I’m sure Steve just like Emerson, gets a nice pay check from his website.) Not to mentioned sue the authors of all the other HP Companion books that are out there.
I have to say, ever since the seventh book came out, some of Jo's actions as presented to the public don't make a whole lot of sense to me. Granted, this one's for charity, but some of her other attempts to place a monopoly on anything associated with her work seem a bit silly to me. Especially that community in India that created a mini-Hogwarts. Where's the harm in that? If nothing else, they were promoting her work. Here in this case, I can see some kind of justification, but really I think that nobody could create as complete an encyclopedia as she can. Anyone who is a devoted Harry Potter fan (myself included) would never believe any Unofficial encyclopedia to be a proper substitute. Is any small dent in sales really worth the negative public opinion, which could potentially damage sales even more? Just something to consider.

Err... you know you can sue for things other than money right? Like, say, sue to stop the release of a book. It's not always about money. And there's a big difference between this book and other prediction books. She has a stated intention to write a book very similar to this one. This book is directly competing with something she wants to do, and as she is the author/copyright holder she has every right to stop its production. I think it doubtful JK would have written a prediction book, thus these weren't competing with her product. There is no problem with the Lexicon on the net. That is not what she has a problem with. The problem is putting it into print to directly compete with her product.
I am on the fence with this one. I love both of them and I think that both are right and wrong. Also, we do not know if the profit fron the book will go in someones pocket or if it would be used to help support the site. I hate this because it like your two best friends had a fight and want you to choose a side!
I wouldn't have wanted to buy that guy's book even if it were published. What almost everyone is failing to see is the fact that this is something of her own creation we're talking about here. If she doesn't want someone using the material she has EVERY right to not let it happen. She's not 'pissing' on anyone, she's trying to conserve what she has written and just doesn't want anyone to interpret things incorrectly. I don't blame her one bit for doing this. Some people have said oher companion books have been made and they didn't get in trouble. I think she would have said something if they didn't have her permissin though, I don't know what everyone else thinks... just something I thought of. Some things I didn't understand her suing about, like the replicas of Hogwarts and the Hogwarts Express. However, this time I am definately on her side also, not only as a fan, but as a writer myself. Trust me, if you write something, you would COMPLETELY understand. (Not trying to make people sound incompetent here, just trying to make a point.)
OMG. And on her site, Jo said that she refers to the Lexicon a lot, and compliments it! Talk about stabbing you in the back! I can't believe this. It sucks. I am actually really angry at Jo and WB. Ergh. We're just fans- it not like we're selling it or anything. =( Good luck Lexicon. But I think we've all learnt you can't win against JKR, or WB. Especcially not combined!

I think this is kinda stupid in a way, but still - it's her choice. It is our choices that shows us what we truly are. In this case, she justifies it by saying that people won't read her own book, which will be published for charity, and the charities will lose money. I just wish there was a compromise. And I feel sorry for Steve - his first contact with Jo, and he's being told of. Yay. Also, could I please draw attention to something else? New month - no new wizard. I don't think she'll ever update that again. But what about the room?
