Rowling to appear in NYC court
Rowling to appear in NYC court As mentioned previously and as many of you are well aware, J.K. Rowling and Warner Bros. are involved in an ongoing lawsuit with RDR Books over a companion novel seeking publication by Harry Potter Lexicon owner Steve Vander Ark. The Associated Foreign Press is reporting this evening that Jo is expected to appear in court in New York City next month.

A New York Federal District Court Judge ordered today that the case go to trial beginning April 14th and Rowling's presence has been requested by RDR Books.

"We asked for her and they said they would provide her," said lawyer David Hammer. "I would say it would be very unlikely that she would not appear," he added.

The witness list must be submitted by April 4th. We will keep you posted as this story continues to develop. Thanks to Matt for sending this in!

Posted by Therinian Mar 24th 2008

It's not likely anything will be decided that day and of course there are the appeals if either side is unhappy with the outcome. Still... I wish JKR and WB lots of luck!

Posted by hpmonkeyaround92 Mar 24th 2008

Good luck Jo... I can't wait for her encyclopedia... they are only taking away from the charity if she does not write it...

Posted by xoxoshannonxoxo Mar 24th 2008

I hope it goes well....I can't wait for the encyclopedia!!! Top Ten!! =-)

Posted by iheartmugglecast Mar 24th 2008

JKR is getting more controversial by the day! We all support you, Jo! =)

Posted by alan_74 Mar 24th 2008

sooo..when is the composer for Hp10 announced?

Posted by The_Fat_Lady Mar 24th 2008

Yeah.. I'm over this story. They need to wrap it up. Stupid really for the lexicon people to persist after Jo asked them to knock it off. If they're fans they need to remember it and respect the author's rights. Sheesh.

Posted by ginerva_weasley Mar 24th 2008

hpmonkeyaround92 - this isn't about Jo's book, its about Steve's. This won't influence her writing the Scottish book in any way. ----------------- The_Fat_Lady - its mostly RDR books being arses, not the Lexicon people. They told Jo's lawyears, when they asked for a copy, to ask one of their interns to show them how to print a webpage, along with other bouts of unhelpfullness. This ensued.

Posted by lovepotion85 Mar 24th 2008

Im sorry ginerva_wealsey, but I agree with the_fat_lady. whether it is RDR books pushing it or not, lexicon has been completely disloyal. As a fan I would think they would understand that everything that has come about has been because of JK and if she says no its NO! This is her idea and world and no one elses.

Posted by purplechoco Mar 24th 2008

top 20! this is so stupid they should just let them publish the book since she is taking forever to write the encyclopedia

Posted by trueligth Mar 24th 2008

The good things take time to do and there is many points to be sure the encyclopedia is as good as the books. So let be patient and we will have the best of the best.

Posted by modern_marauder Mar 25th 2008

Lexicon should have thought about this before they thought about publishing. This case could jepordise all FanFic and Wizard Rock etc. and thats the last thing the fandom wants. Hopefully all works out well.

Posted by PeopleAtMyWindow Mar 25th 2008

Just because Rowling wrote HP does not make her God or right all the time, which is how some (note: some, not all) people think and therefore why they support her in this case. I just needed to make that make that point. Please read the facts before jumping at the chance to back JKR.

Posted by LadyLilyMalfoy Mar 25th 2008

I do think that JK is taking this a bit too far, I mean, she's written the books now and, as much as it pains me to say this, she needs to move on. Personally, I think she's clinging onto HP way too much and it's starting to annoy me. I think it would be really nice to see a fan written book. BUT I do think that Steve shouldn't have just gone ahead with the publishing. If he is a fan, to get on the bad side of JK just isn't worth it :P I love the Lexicon, it's like a bible, but it can be read on the net and I don't think it's fair if it threatens fanfiction, art or Wizard rock :P

Posted by Shirley_hpf Mar 25th 2008

Yay, top 25... or something. ^^" Like it matters. Anyway, I really want to know how this is going to end. Good luck Jo!

Posted by last_black Mar 25th 2008

Best of luck Jo!!

Posted by angelina_johnson92 Mar 25th 2008

Good luck Jo! She'll win for sure. I don't know why so many people think that shes taken it too far. She said the books are like her children. She oves them. The encyclopedia is just a book that's telling what happened in the series. We don't need it. It would be cool to read it but you can just read the website without paying $30.

Posted by tiassa Mar 25th 2008

@PeopleAtMyWindow--I don't support Jo because I think she's god. As she proved to us many times she is just an incredibly good human being. I support Jo because every human has a right to three things: life, freedom, and property. Property can be real and can be intellectual. An example for intellectual property is *drum roll* COPYRIGHTS! That's right Jo has copyrights as she is the sole creator of HP. If she chose to sell these copyrights to WB then they are WB's copyright. Now despite what you may think, the HP fandom can read(suprise suprise) and it has read the facts and after finding no sense at all in SVA statements and since Jo's claims were full of logic it decided to support Jo. We did think, you are just angry because we didn't think like you. that said, Good luck Jo!

Posted by Kareen Mar 25th 2008

This again? When is Jo going to realize that this is completely stupid of her to do and just drop it? It's not going to prove anything! They aren't stealing anything from her! As long as they give reference to the fact that she created the characters and the story then WHO CARES?! Its not like those other cons who went and tried to say that she plagiarized their stories! This is over an UNOFFICIAL guide to Harry Potter!

Posted by Quantummilkshake Mar 25th 2008

Uggghh. It's Jo's book and her right to decide what she does and does not want fans to be able to publish. End of story.

Posted by RabidSphinx Mar 25th 2008

What a girl. Go Steve. I hope Jo gets hit by a bus on her way out of the court, THAT would be something finally interesting to read on this site.

Posted by Fawkesdog Mar 25th 2008

They really just need to drop it :( they're her books and if they like them so much to write a book on it they should respect the author. Show some R-E-S-P-E-C-T dogs!

Posted by slytherin8 Mar 25th 2008

I totally agree with Jo. When they 're your characters that you created, then nobody has the right to make profit off of them except you! Samantha

Posted by RabidSphinx Mar 25th 2008

Jo is an arrogant self-absorbed narcissist with only a scrap of discernable talent who is clinging FAR to hard to her HP fame to stay relevant, exploiting fans and manipulating youth. Over what? a semi-interesting story that isn't all that well written? I am a fan of the stories, but not of the actual books, and most certainly not of her. Her god-complex is sickening, almost as sickening as how terrible the 7th book was. She needs to stop thinking how smart and clever she is, and how stupid and gullible we are, and start realizing that her fanbase is what sustains her, and that this "UNOFFICIAL" HP guide is NO DIFFERENT than any OTHER "unofficial" guide to any other story. Honestly, no rights were encroached upon because all acknowledgments were made, Jo is just mad that she wont be in the forefront for the wave of paychecks. She is a terrible person, hiding behind a publicist created facade of charming English once-single mother. Seriously, she isn't fooling anyone. then again =looks up at above comments= apparently she is.

Posted by MissTonks Mar 25th 2008

I do not believe that it is right saying that one hopes she gets hit by a bus. It just seemed inappropriate to say. I do not believe that JK has a "god-complex." I believe that she hoped to write an encyclopedia for her fans, and the Lexicon is being terrible by letting this drag on for as long as it did. She owns all rights to her characters, ideas, etc. While it is true that the Lexicon is merely publishing information that JK has given, it just seems so un-fan-like to go against the author's wishes. Furthermore, the money made by the publication of this book will most likely go to a decent charity once JK decides to publish her own encyclopedia. It is my understanding that JK should have the ultimate say as to what happens with her characters and her books; after all, she did write them herself and hoped to provide her own encyclopedia. If the information is desired, go to the Lexicon if all it is going to be is that in print form. Let JK write the encyclopedia and have fans get giddy over it. For the person who said she is "taking too long to write the encyclopedia"- you are an extremely demanding fan. Not only are you extremely demanding, you are somewhat unrealistic in the turn-around rate at which you expect things to be done. JK just finished writing the series that took her seventeen years to make... she should be able to have time to herself to collect all of her thoughts. No creator- author, artist, musician, fil-maker, is as pressed as she is to create. The demand must be absolutely taxing, and she finally is allotted a break because her novels are finished. Please do not think she is "taking too long." That is ridiculous. JK has been extremely good in allowing publications involving her work go, and she asked this one time for the company to not go through with it. She has the greatest reason- because she wants to do it herself. Why are fans so problematic with this dispute? I would prefer the author to write this encyclopedia than Steve (no offense ...

Posted by MissTonks Mar 25th 2008

to the HP Lexicon, of course. I am a fan. Totally helpful.) I just think that this problem is definitely putting a light on the way that fans and authors could act. It is terribly depressing because this Fandom always was responded to well by JK. It is sad, really. Well, that is enough from me definitely. Good luck, Jo. I wish the best for you.

Posted by lilyevans412 Mar 25th 2008

Best of luck Jo!

Ah. More about the lawsuit. Well, best of luck, Jo! (I'm just glad that MuggleNet is back after its little Easter break).

Posted by dinky_diddy_kins Mar 25th 2008

I think this whole thing is best argued by Tim Wu from The Slate: But Rowling is overstepping her bounds. She has confused the adaptations of a work, which she does own, with discussion of her work, which she doesn't. Rowling owns both the original works themselves and any effort to adapt her book or characters to other media

Posted by Fawkesdog Mar 25th 2008

Rabid Sphinx, ya shes extremely selfish because she made and contributed greatly to her Multiple Sclerosis charity. ya, she should die of guilt.

Posted by str8_up_lee Mar 25th 2008

arghh this is getting broing ppl need to drop it

Posted by hpwiz812 Mar 25th 2008

OMG! can they just drop it??? please? for the sake of everybody

Posted by Kamion Mar 25th 2008

well it took an actual crying and then again a yelling scene by JKR's lawyer to get the the case delayed so long that JKR had time to come in person..... a real embaresing conduct that annoyed the judge in court majorly. Sorry but JKR/Warner's side ain't earning any Housepoints in this and it's good to see reactions at this site realising this too. I certainly don't hope she gets hit by a bus, but I think the verdict of an unpartial jury will hit her hard enough

Posted by tiassa Mar 25th 2008

@dinky_diddy_kins - Steve said there is no analyze. just the book. meaning no disscussion

Posted by Kamion Mar 25th 2008

@dinky-diddy-kins - thanks for mentioning the Tim Wu article, it was by far the clearest analysis about the case. 2 those who want to read it go to: -------http://www.sl ate.com/id/2181776/------ --- When I posted this link at the Leaky Cauldron forum my post was deleted and my futher posts blocked.

I don't understand why there are ppl who seem to totally hate Jo on this comments section -- why should they even bother being on Mugglenet in the first place if they seem to detest Jo, the author of the entire series, so very much???!! As an aspiring writer myself, I am appalled at how callous society has become with the original work of writers. Original work is being posted on the Internet without disclaimers (thankfully, Mugglenet is prudent enough to acknowledge that they are an unofficial fansite), and this is very disturbing to me. If a writer chooses to spend their own time and hard work on a piece of writing, then others should respect that and quit attacking their rights!! Why do you think we had the recent Writer's Strike in the U.S.? Because the screenwriters were not being treated with the same level of respect that most professionals have come to expect, as a matter of common sense!
