The Detroit Free Press is reporting this morning that a notice of appeal will be filed by attorneys on behalf of Roger Rapoport and Steve Vander Ark in an attempt at "preserving the men's right to continue the legal battle for their Harry Potter book." As reported last week, Judge Patterson ruled in favor of J.K. Rowling and Warner Brothers stating that The Lexicon takes too much from Rowling's work. Rapoport and Vander Ark are looking into editing the current edition of the book. No statement has been issued by either J.K. Rowling or Warner Brothers at this time.

FIRST!

Posted by: - Posted on: 2008-09-15 10:52:52

Vander Ark should just GIVE UP, hes not gonna win!

Posted by: - Posted on: 2008-09-15 10:55:45

Hmmm, the Lexicon website no longer seems to be working. If he has closed the site out of spite, then I have no sympathy for him. He should have contacted JKR before putting the website into book form and offered to work with her on HER encyclopedia.

Posted by: - Posted on: 2008-09-15 10:56:22

Wheres MUGGLECAST?

Posted by: - Posted on: 2008-09-15 10:58:32

Er... seriously, hes starting to look like Hillary Clinton. Its time to realize you didnt win!

Posted by: - Posted on: 2008-09-15 11:01:46

By the time the appeals process is finished and everything is over and done with, any money he would make from this lexicon will have been used up in legal fees. He should just quit now and cut his losses. He can still edit the book and try again, but dont appeal this.

Posted by: - Posted on: 2008-09-15 11:02:51

Crookshanks800, apparently the site is "undergoing technical difficulties". Im sure the Lexicon will be back soon, but I must say that it has been behind on updating a lot of pages... I mean, its been over a year since Deathly Hallows came out, for goodness sake. As to this news post, I wish RDR and Steve would quit wasting everyones time. If J. K. Rowling ever told me to stop doing something, I most certainly wouldnt need telling twice!

Posted by: - Posted on: 2008-09-15 11:07:10

Dude. She said "NO". He should just give it a rest and move on to his next book that is supposedly going to be published next month. I wonder if he realizes how much bad press hes creating around his name... I know I wont be buying his next book, or his encyclopedia either. I definitely want the encyclopedia by JKR because, you know, she was the one who created the series and knows much more about her characters than anyone else could possibly imagine.

Posted by: - Posted on: 2008-09-15 11:10:06

I dont understand what he expects to gain from this. The judge ruled in Jos favor, and obviously she doesnt want him to publish the book, so Im struggling to see what hope he has of an appeal.

Posted by: - Posted on: 2008-09-15 11:18:49

Why are they dragging this out? Honestly.

Posted by: - Posted on: 2008-09-15 11:22:22

i mean come on!!!!!!!!!!!!!!!!!! THEY JUST DONT LEARN DO THEY? I MEAN ALL THE POSSIBLE ARGUMENTS AND COUNTER ARGUMENTS THAT COULD HAVE BEEN GIVEN ARE ALREADY GIVEN!!! WHAT NEW THING IS GONNA BE DISCUSSED IN THIS? HOW CAN THE ARGUMENTS CHANGE....I THINK THEYRE WASTING THEIR MONEY AND JKRS TIME

Posted by: - Posted on: 2008-09-15 11:31:55

As soon as he signed that contract, Steve is their dog on a leash. They probably gave him a decently sized advance too. Although Im not sure Id say hes completely innocent, he might just be getting jerked around by RDR.

Posted by: - Posted on: 2008-09-15 11:36:41

Warner Bros has far more money and better lawyers and they have the RIGHT on their side. RDR needs to back off before they get blacklisted in the publishing industry.

Posted by: - Posted on: 2008-09-15 11:45:50

WAIT. WHAT? Theres going to be a lot of editing if the appeal is granted and SVA gets a chance to publish that book. He should give it up, accept defeat, and continue working on the travel guide! P.S. Crookshanks800: I just tried the site; its working okay! ... http:// hplex. org/ ... (remove spaces, obviously); try it now!

Posted by: - Posted on: 2008-09-15 11:46:17

UGH!! Laaaaame! Let it go, dudes. Its over. Jo wins, as she should. RDR needs to learn to cut their losses and not make themselves look like idiots and NOT get more bad publicity, because theyre GOING to lose again. All their doing is making people resentful toward them, because lets face it, most people are going to side with Jo.

Posted by: - Posted on: 2008-09-15 12:25:36

Ima boycott.

Posted by: - Posted on: 2008-09-15 13:03:58

EFF This guy!!! Write your own god-damned books!

Posted by: - Posted on: 2008-09-15 13:07:21

Really? I mean, come on! Standing up against JKR the first time wasnt enough? He shouldnt appeal this court verdict. Maybe if he edits the book and actually lets WB and JKR see the book when they request it, hell not have the same problems.

Posted by: - Posted on: 2008-09-15 13:31:45

Wow, this is ridiculous. Most of us were still rooting for him when it was revealed that he was writing a travel guide instead, but if he continues to beat a dead horse like this, everyones going to lose interest in everything he does. Although this is probably largely RDRs fault, any self-respecting publishing company would know better than to keep fighting on the wrong side of a publishing war. Steve and RDR, move on with your lives!

Posted by: - Posted on: 2008-09-15 13:38:07

I honestly dont see how they could edit this book without still totally ripping her off. He should just give up and get a life! As if they havent wasted enough money and time fighting JK, when it was pretty obvious they werent going to win anyway!

Posted by: - Posted on: 2008-09-15 13:39:36

R U SRS?! Come on, lawyers! Give up already! Just when I was starting to become less irritated with SvdA...

Posted by: - Posted on: 2008-09-15 13:44:12

ew...NO.

Posted by: - Posted on: 2008-09-15 13:44:54

Steve and RDA has every right to appeal complete travesty. If WB and JKR lost they would also have appealed. It is all part of the legal process. You never give up until you fire everything you have.

Posted by: - Posted on: 2008-09-15 13:45:43

Youd think if you were a fan of a book, so much to the point that you wanted to write your own book ABOUT THAT BOOK, that when the author asked you not to, youd respect that and leave it alone. How stupid is this guy?

Posted by: - Posted on: 2008-09-15 13:46:27

I commend them for trying, I still think JKR and WB are being selfish bullys...but they have no chance. Its a squirrel fighting a grizzly bear.

Posted by: - Posted on: 2008-09-15 14:11:59

"For their harry Potter book"? thier? honeslty, i can tell you that its not steve! HIS PRODUCTION COMPANY IS PUTTING FIRE UNDER HIM! THEY1 KNOW THW BOOK is GENERATING BUZZ, AND IF THEY SUCCED THEYLL END UP GETTING MONEY!!!!!i hope the judge realizes this..................... ..................

Posted by: - Posted on: 2008-09-15 14:24:09

What sort of "fan" disobeys JKRs wishes? How exactly is JKR a bully? Theyre her characters! Stupid, stupid, stupid.

Posted by: - Posted on: 2008-09-15 14:27:04

Give it a rest....this is so stupid. Its not their Harry Potter book. Did they create the characters, the plot, did they put in the hard work in the hours to make these books. I think not...so give it a rest. Its J.K Rowlings story...her life. I cant figure out where people get off as J.K Rowling is a bully...its her well earned time that she should pretty much own her characters her plot everything that deals with Harry Potter.

Posted by: - Posted on: 2008-09-15 15:08:32

oh just get over it!

Posted by: - Posted on: 2008-09-15 15:13:19

THREE FACTS 1. STEVE CONTACTED JKR, BUT JKR GAVE HIM THE COLD SHOULDER. 2. STEVE WAS ASSURED BY RDR THAT HIS BOOK WAS LEGAL WHEN HE EXPRESSED DOUBTS. 3. COMPANION BOOKS TO NARNIA, LORD OF THE RINGS, ETC. ETC. EXIST TO PROVIDE READERS WITH AN ENCYCLOPEDIA OF INFORMATION. I used to idolize JKR and WB, and while I commend her efforts in charity, SHE, in fact, caused the situation by refusing to communicate with Steve. Steve offered to provide the information for JKRs encyclopedia, but JKR refused. The recent cases (WB & JKR suing everyone/thing who bears any resemblance to Harry Potter) has made me lose a lot of respect for them. Good job WB & JKR for creating a situation that could have easily been avoided and exhibiting the most hypocrisy I have ever seen!

Posted by: - Posted on: 2008-09-15 15:27:30

@ bubblettes: THREE FACTS 1. STEVE CONTACTED JKRs LITERARY AGENTS AND BEGGED FOR A JOB AND WAS POLITELY TURNED DOWN; 2. RDR DID ASSURE STEVE THE BOOK WAS LEGAL AND EVEN WENT SO FAR AS TO INDEMNIFY STEVE FROM LAWSUITS BROUGHT AGAINST HIM BY JKROWLING~RDR CLAIMS TO HAVE CONTACTED AN INTELLECTUAL PROPERTIES ATTORNEY TO ENSURE THIS BOOK WAS LEGAL, YET PROVIDED ZERO PROOF IN COURT AS TO WHO EXACTLY HED CONTACTED; 3. YES, INDEED, MANY REFERENCE WORKS BASED UPON POPULAR NOVELS EXIST, HOWEVER, THOSE THAT DO EXIST DONT COPY 91% OF SOMEONE ELSES WORK VERBATIM.

Posted by: - Posted on: 2008-09-15 15:35:04

why is he doing this? isnt he aware that his pushing Jo like this can end up drasticaly hurting the fans? if she decides to not write her encyclopedia because someone decides to let him write his, i sincerely hope that we, as harry potter fans, can unite to egg his house and demand that he apologize to Jo and every harry potter fan in existance.

Posted by: - Posted on: 2008-09-15 15:46:50

If they want to fight Jo like this, if they dont care that she does not want them to publish a book that is about HER own books, then why have they written it in the first place? If they want to support Harry Potter, they would respect Jo. I think that if any other HP fan was in that situation, they would fall on their knees and beg for forgiveness for Jo, not try and fight her.

Posted by: - Posted on: 2008-09-15 16:08:33

Quit while your still ahead!

Posted by: - Posted on: 2008-09-15 16:09:09

This is too much. Give it up or make the changes...

Posted by: - Posted on: 2008-09-15 16:40:11

That is soooo STUPID!!! Just GIVE UP already, and leave Jo alone! You already lost so dumb! What is he expecting to gain from this??

Posted by: - Posted on: 2008-09-15 16:40:34

I am sorry but what a pair of tools. Give up, get over yourself and move on. That sounds very spiteful and childish, but from what I read of the Court Transcripts the Judge has perfect grounds for making his decision.

Posted by: - Posted on: 2008-09-15 17:35:35

Come on guys, give it up. Well, as long as they dont reach "Laura Mallory spaz" levels, Ill try not to complain.

Posted by: - Posted on: 2008-09-15 19:16:37

Oh god. Here we go again. Seriously, just give up. Youre not going to win. Move on and write a book that doesnt violate copyright infringement.

Posted by: - Posted on: 2008-09-15 19:41:45

bloody hell

Posted by: - Posted on: 2008-09-15 20:21:00

So, because JKR said that he should stop, he should stop? Right. I wanna read the book, it seems cool. Oh, anddddd, you guys are ignorant farts. ID I look Id name calling too!

Posted by: - Posted on: 2008-09-15 20:38:03

Steve! Dont you realize how upset youre making Jo? Remember almost a year ago...? If this interferes with Jos writing of fthe encyclopedia, Im not going to be happy. =[

Posted by: - Posted on: 2008-09-15 21:35:06

AnnaSmee, were being ignorant? For not wanting to waste our money on a book that no hard work, imagination, or care was put into? A book that only organizes everything we already know and that we can find on the internet for free? He took another persons sweat, blood, and tears, added not thought of his own, and intended to make a nice little profit off of it. I say "he" from lack of better word. I really dont blame Steve. It was a bad, bad mistake and for all we know, he could be as against this now as we are. But thanks to those darn contracts, he has to consent to what ever RDR says and have his name dragged up on what they do. I dont blame Steve.

AnnaSnee, if you wanna read the book, why havent you done it yet? Its in the court documents at justia.com, search Lexicon, select WB vs RDR, youll find it in filing 39, attachments 1-5. I want drop $25 for that drivel!

Posted by: - Posted on: 2008-09-15 22:23:05

oh...over posting again

Posted by: - Posted on: 2008-09-16 00:08:52

GOOD, I hope they win.

Posted by: - Posted on: 2008-09-16 00:29:12

Its her work! She DOES acknowledge that other books have been done about HP and shes fine with it..she just doesnt want something that takes her work word for word and rightly so. Let her handle the direct reference books. Especially since she actually wants to do it! If she wasnt ever planning on making an encyclopedia then this might be a different story. But seriously its as simple as..she made the story up, she SHOULD have the final word on ANY books published about them. Even if the law had nothing to do with it, its just respectful. At least..its what Id want for my work if I spent as much time as she did on HP.

Posted by: - Posted on: 2008-09-16 03:30:56

Just stop Steve, please. I cant believe people stick up for him when he went against Jo. That information in his book is not his! The writers of other encyclopedias put their own work, opinions, and made sure to give sources to where they got the information from. They are smart. Steve obviously has no knowledge in writing a book! Dont you learn in school about a Bibliography page when you do research for a paper? Also dont you know that when you write a book you dont just put information that is already free for the public! This just pisses me off!

Posted by: - Posted on: 2008-09-16 11:55:42

Lol tonks, yes youre ignorant, steve knew there would be legal trouble and if he didnt hes an idiot. He is completely to blame for the whole thing. That said I hope jkr loses because i dont like her.

Posted by: - Posted on: 2008-09-16 14:16:23

woah Grnd3lw4ld, why dont you like her?

Posted by: - Posted on: 2008-09-16 15:05:03

It started with the epilogue because it was complete crap. Then suddenly making dumbledore gay. Then things like crying in court and being a b itch about the lexicon thing. And some other stuff

Posted by: - Posted on: 2008-09-16 15:11:38

Grnd3lw4ld you do realise that if she says someone is gay their gay..right? regardless of how late in the series. the characters are of her creation and anything she decides to Add no matter how much later is...true for example say she says filch had a kid with a former student (ew i know) but still, she is like "god" in the sense that, what she says goes its a world SHE made. Therfore if she says hes gay, then BOOM hes gay. as for the epiloge, thats your opinon, i read it and liked it, i never really like the last chapter of any book.

Posted by: - Posted on: 2008-09-16 15:24:56

Did i ask people opinions on the resoning of my dislike of people? I dont think so, I just stated them when someone asked to. Regardless my problem with it isnt that dd is gay, i really couldnt care less.

Posted by: - Posted on: 2008-09-16 15:28:48

easy squeezy lemon peazy...i have a right to say my opinion...regardless...do nt be so discruntaled

Posted by: - Posted on: 2008-09-16 15:37:25

Youre right, you can say whatever you want. But i really dont need any clarification on dumbledores sexuality. It doesnt mean im disgruntled.

Posted by: - Posted on: 2008-09-16 16:27:47

Grnd3lw4ld twas a joke friend

Posted by: - Posted on: 2008-09-16 16:42:17

Oh for gods sake...this is too much. HE NEEDS TO JUST SHUT THE HELL UP AND GO WRITE HIS OWN darn BOOKS WITHOUT STEALING JOS IDEAS. This is beyond stupid. Is he honestly THAT desperate for money? Is it worth losing the respect of the fans and Jo? His bloody rights can kiss my ass...Steve Vander Ark is done.

Posted by: - Posted on: 2008-09-16 16:45:35

No it wasnt. Next time you jump do a flip

Posted by: - Posted on: 2008-09-16 18:42:36

when i said that you were discruntled it was a joke everything else i meant, it seems like your looking for an argument, well your not going to find one here.

Posted by: - Posted on: 2008-09-16 19:43:47

OMG! I thought this was over?? Steve, youre a cool dude, but drop it already will ya? A lot of potter fans are mad, do you think were gonna buy this book anyway!??!????

Posted by: - Posted on: 2008-09-16 20:17:05

I thought the epilogue sucked too. Im tempted to rip it out of my book but I cant bring myself to do it. Understandable why that other stuff would bug you though. The lexicon stuff does seem a bit harsh but thats business..although I do side with her on it anyways, just seems shes in the right on that.

Posted by: - Posted on: 2008-09-16 20:40:34

Lol dont blame you there, good idea actually. I think shes right too legally anyway

Posted by: - Posted on: 2008-09-17 02:20:59

I dont believe this guy is still trying to do this and waste all that money to publish a book of something that is not written entirely by him! He went to court and was told no. Plain and simple! Now he wants to try again just be editing the content? What for? I had some sympathy for him when this started. I thought he might have learned something. Besides, who would really want a book on it when Jo will be writing one eventually and will have a hell lot more details than his book will ever have.

Posted by: - Posted on: 2008-09-17 14:47:12

Wow, this is beyond stupid. This is like Laura Mallory stupid. Do they actually think they can win?

Posted by: - Posted on: 2008-09-17 14:47:41

Voldemort, dont mind Grindelwald. He looked for an argument when this whole thing started months ago, and there was major verbal warfare on comments page. If he wants 2 try again, every1 ignore him. When people like him will learn that people DO have the right to express their opinion, and is downright chilsish to attack others for their beliefs, i have no idea. SVA made a mistake when he signed this contract with RDR books. However, whether RDR wins or loses., they will be hated, and WB can blacklist them. And so ends the success of RDR books. No more RDR. Jo won the first round. If RDR and their Puppet-attack-dog SVA calls for a second, they can. But, its now mass public opinion, no matter what the judge says, that RDR can kiss the worlds ass, and Jo has the right to her books, which r more popular than hell ever be. Honestly, its like the world isnt safe for authors to protect their works anymore. I root for Jo 100 percent. Steve is gonna lose credibility, IF he didnt already. Btw, in my opinion, the Epilogue was ok. But I think Jo shouldve left it to readers to speculate what happened next. But if she says Dumbledore is gay, hes gay. Just like she said Neville married Hannah Abbot, (and there I was thinking shed marry Ernie. Surprising. Well, theres always Susan Bones, lol.)

Posted by: - Posted on: 2008-09-17 16:47:24

Right right, everyone has a right to express their opinion. But they should ignore mine because its different from your opinion. lololol

Posted by: - Posted on: 2008-09-18 04:58:46

i love lexicon! if they delete it ill complain!

Posted by: - Posted on: 2008-09-18 18:02:18

Oh no Grindy. Nothing like that. Its just that- u attack everyone based on their opinion, and accuse all of us of being blind Rowling maniacs. We get it. You hope RDR and their puppet SVA wins. We have different opinion. Anyone can express whatever they like, but u take it so far and attack us personally. But people should remember, this site is for die-hard Potter fans, and we can expect the majority of us, a strong one i might add, to support Rowling in this case.

Posted by: - Posted on: 2008-09-19 18:24:14

Oh dear god, not this AGAIN

Posted by: - Posted on: 2008-09-20 20:55:58

Harry_Potter_Prince thanks for the support! Grnd3lw4ld_ i more then respect your opinion, youre on mugglenet for a reason no? trust me if there is an unjustifed attack on you we got your back. Thats how we are. But honestly, i looked at both sides before i picked one. i chose Jos you chose the production company. there is a baised in mine but i didnt let that hamper my judgement. No need to sharpen the claw and brandish the swords. That last sentence goes for everyone.
