Deceased author's estate sues Bloomsbury over Potter Author Adrian Jacob's estate filed a lawsuit against UK Potter publisher Bloomsbury today, claiming that JK Rowling stole the plot of Jacob's 1987 novel The Adventures of Willy the Wizard-No 1 Livid Land. From the Estate's press release:

Both books describe the adventures of a main character, "Willy" in Jacobs' book and "Harry Potter" in Rowling's, who are wizards, who compete in a wizard contest which they ultimately win. Both Willy and Harry are required to work out the exact nature of the main task of the contest which they both achieve in a bathroom assisted by clues from helpers, in order to discover how to rescue human hostages imprisoned by a community of half-human, half-animal fantasy creatures, "the merpeople" in Harry Potter.

Bloomsbury quickly responded with a press release of their own. Our friends at HPANA received a copy of the statement and passed it along to us. An excerpt:

...this claim is without merit and will be defended vigorously. The allegations of plagiarism made today, 15 June 2009, by the Estate of Adrian Jacobs are unfounded, unsubstantiated and untrue.

JK Rowling had never heard of Adrian Jacobs nor seen, read or heard of his book Willy the Wizard until this claim was first made in 2004 -- almost seven years after the publication of the first book in the highly publicised Harry Potter series and after the publication of the first five books.

Willy the Wizard is a very insubstantial booklet running to 36 pages which had very limited distribution. The central character of Willy the Wizard is not a young wizard and the book does not revolve around a wizard school.

I am between being incredibly mad and laughing about this. People keep trying to tap into the financial wealth of Harry Potter by claiming plagiarism, and all of it has been COMPLETELY unfounded. I wish people would stop trying to be Potter parasites, and figure out their own way to make money. This author is dead, I doubt he would sue Bloomsburry if he were alive to make the decision.

that is completely ridiculous! i mean..really. i think someone is just a little bitter that their author's wizard story didnt get as popular as harry potter. it probably doesnt even deserve to be used in the same sentence as hp..much less compared to it. jk rowling did not steal people ideas obviously. her stories are so unique and creative. i agree with Feathery_Golden_Snidget.. people should stop trying to get into the money hp makes. :]

What! That is bloody mental!!! >:P That is wrong! Oh, honestly, how in Merlin's Beard is supposed to have plagiarized if she has never even heard of it! And if you ask me, that kind of plot is rather common in high fantasy, whether it be in the tournament or not, the there is almost always some one to rescued and a bathroom is an odd place to think so that is just coincidence! As for merpeople, c'mon, half-bloods as baddies are very common, werewolves, centaurs, a lot of fantasy animals are half-breeds! And if you are going to sue about a creature, then that is kind of like suing Christopher Tolkien suing for use of elves in other books!

What I really, really love is that if you go to the OFFICIAL (and *ahem* newly constructed) Willy the Wizard website, you'll see how they (I'm assuming the author's estate) have posted excerpts from the booklet that REALLY REALLY strive to draw a parallel between Willy the Wizard and Harry Potter--Right down to a sentence that has the word "honey" and the word "dukes" in it. These people are out of their minds. The writing is ATROCIOUS. I love it.

Are they serious? So from now on, any story which contains a contest or a character entering a bathroom is considered a copyright infringment of Willy the Wizard? These people need to get real. If there was ever a case of someone trying to take a bite of JKR's pie, its this one. I hope JKR's people counter sue for damages and get heaps of money.

Thats kind of odd, i agree with alot of the comments right now, why all of a sudden would you pull the old, she stole/he stole, after its been released for more than 10 years now? Something says their just doing it for publicity, or they found an old manuscript, that was never published that has some of the same ideas, but this remains inconclusive. I think this will be funny to see as it unfolds.

I do believe The Bard has it right concerning the members of the legal profession, especially when it comes to frivolous lawsuits such as this. Still, since this case was filed in the UK, the rules are that the loser pays the cost for both sides. Does the estate of this long dead author have enough cash to pay out when they lose?

I think we're at a point in literature history where ideas in one book can seem very similar to another, not because of plagiarism but due to the fact that most ideas concerning our modern world and the past have been explored in some way or other by now. There's very few original combinations of ideas left that do not bare some resemblance to another book, play, movie, etc. in some way. As long as there are enough unique details in Harry Potter to differentiate its greatness from crummy little pamphlets about other wizards and the like, the small similarities really don't matter and do not support a law suit.

They know they're not going to win. It's just a publicity stunt. They hoped that they would get tons of media attention (which they have) and then everyone would go see what all the fuss was about and whether the two books are the same. It dispicable, but at the same time a freakin genius marketing ploy. I mean, how many times have you read on the back of a book "the next Harry Potter." These guys just took it one step further and cry plagarism so everyone assumes it's just like Harry Potter. I don't know whether to slap them or give them a marketing award. The things people do for money ...

That Willy website is hilarious! I have never in my life seen an author's website set up just to prove his / her work was plagarized. It just has a bunch of links to things that are "similar" to Harry Potter. Man, they just keep it coming. I don't even know what to say.

Haha, well, this is one person they will not ensnare to read Willy so easily! They are a bunch of gits, but it is just a low way to publicize Willy! I bet the guy is having a big laugh right now. I hope nothing bad comes of this! I know these are bad times, but that is low. What is really bad is that the Willy Fight is defacing someone that younger kids look up to! I mean, I for one would not the book lover I am if I had to read Harry Potter, so many younger kids, kids of the new generation are learning to love books because of her and other authors, not only is this putting JKR in the bad light, but also other authors, people tend to stereotype certain people because of these things, if you get my meaning. Example of this: there are actors and actresses that are not, well, not very good role models, so some people stereotype actors and actresses as such.

I agree with you Padfoot777, I'm tired of people (esspeciallythemediacough cough) trying to give Jo a bad name. They've succeeded somewhat too, which is horrid. Some of my friends have made snide comments which they think are clever (they're not) about how she plagiarized the books, because of that last plagiarism suit. (you know, the one that Jo WON). This was due to the fact that the news of her winning the case and being cleared wasn't as highly publicized as the headlines "JK ROWLING GOES TO COURT FOR PLAGIARISM" were. It's all insane. I hope this doesn't further damage her reputation undeservedly. :(

why does everyone always try to play the victim against jkr? i can understand why there would be jealousy there, but come on people. this is this most famous book series in the world..the last book sold the most copies of any book ever (other than the bible)! can every one just accept that jrk is a genius and that she has endless writing ability to be able to come up with such an amazing world? do people really just think of ways to try to gain some of her fame because their lives are too pathetic to live?

I'm guessing the author who passed away didn't leave them enough money so they decided to make some PATHETIC claim and get some from one of the richest authors in the world just because they're Grandfather's "PAMPHLET" is about a wizard who did something in a bathroom and ended up under a lake with half human creatures!! ARE U KIDDING ME?!! So What?! That's not plagarism. Plagarism is word for word! Just because there's an extrememly small hint of similarity (supposedly) doesn't make it plagarism. And who in the World is that author??! I've never even heard of him!
