Jacobs' estate looks to appeal, will pursue lawsuit in British court against J.K. Rowling

Last week, we told you that a U.S. judge had dismissed the lawsuit brought against Scholastic by the estate of British author Adrian Jacobs, claiming that Harry Potter and the Goblet of Fire was "substantially similar" to Jacobs' 1987 book The Adventures of Willy the Wizard.

Well now it seems lawyers for the estate may look to appeal the judge's decision, and Trustee Paul Allen says the estate will continue to pursue its claim in British court:

"This US decision has no legal bearing upon the Estate's established action in the High Court of England against J.K.Rowling personally and her publishers Bloomsbury over breach of copyright in Harry Potter and The Goblet of Fire."

That case is scheduled for a 10 day trial in February 2012 when the estate hopes that evidence (forensic linguistic analysis, factual testimony and evidence from experts in children's fantasy literature) and cross examination will be heard in open court for the first time.
